Research On The Balance Mechanism Of Persoanl Information Protection And Utilization

As personal information should be both used and protected,this dual targets lead to conflicts between the protection and use of personal information in aspects of principles,rules and practices.At present,the nature of the personal information right of a natural person should be clarified,and the content of the right should be determined on the basis of existing laws and regulations.Correspondingly,the rights related to personal information possessed by enterprises should be determined as soon as possible.For example,the nature of the original personal information collected by enterprises and the personal information data after mining and analysis,as well as the rights owned by enterprises in these two steps should be determined.Therefore,the special laws for personal information protection should be legislated,in order to define the nature and the contents of the personal information right and to determine the enterprises' rights and the obligations related to the personal information protection.On the basis of the rules,we will balance the conflicts between protection and utilization of personal information through various dimensions including industrial self-discipline,public participation,governmental regulation.
