With the increase in the number of elderly people year by year,China 's social pension and family pension are facing huge challenges.The social security situation of the elderly is not optimistic.The use of market mechanisms to establish a reasonable and feasible pension model is an effective development direction in the current situation.The reverse mortgage system of housing is a useful exploration in this direction.It can meet the living needs of the elderly to a certain extent,improve the material living standards of the elderly,and can reduce the economic and mental pressure of children's pensions,thereby promoting the economy.Promote and promote the sustainable development of our economy.However,the current practice of exploring reverse mortgage in China is not ideal.The relevant legal system has not followed the reform process in time,and there are many shortcomings.Moreover,this deficiency has become a weakness in the development of the reverse mortgage system.Therefore,it is the proper meaning of this article to study the operation process,implementation effect,and existing problems of the housing reverse mortgage system as the starting point.The content of this article is mainly divided into five parts.The introduction of the first part mainly introduces the background and significance of the topic of the dissertation,the current status of research at home and abroad,research methods and innovations.The second part is an overview of the reverse mortgage system.Starting from defining the concept of reverse mortgage,it summarizes its connotation and legal characteristics,and compares the reverse mortgage and the bequest maintenance agreement.Based on a comprehensive analysis of the nature of reverse mortgages on housing,it is determined that reverse mortgages on housing are a special new type of mortgage.The third part is the status quo and existing problems of China's housing reverse mortgage system.Firstly,we introduced the pilot situation of housing-based retirement in China,including the Nanjing Hot Springs Retirement Center and the CITIC Bank's housing-replacement model,Shanghai house sales and leaseback model,and commercialized pension insurance model,and summarized the above practice models.On reflection,on thisbasis,the problems existing in the practice of China's reverse mortgage of housing are pointed out from the aspects of subject,object and content.At the same time,this article also analyzes the current situation of the reverse mortgage system,and raises three issues: the specific procedures of the reverse mortgage system are not clear,the supervision mechanism is not perfect,and the supporting laws are incomplete.The fourth part is the comparison and inspiration of the reverse mortgage system for extraterritorial housing.It mainly introduces the implementation status and operating mechanism of the system in foreign countries.Through a comparative analysis of the US reverse mortgage system,the British real estate value release system,and the Japanese housing pension system,It summarizes the advantages of the main body selection of housing reverse mortgage,perfect laws and supporting systems,government support and supervision,and provides a reference for improving China's housing reverse mortgage system.The fifth part is the proposal to improve China's housing reverse mortgage system.Firstly,based on the general idea,it is suggested to refine the subject,object and content of reverse mortgage on the basis of perfecting the property rights law.Secondly,combined with practical experience at home and abroad,in view of the problems existing in China,the following specific suggestions are put forward: first,the main conditions of the reverse mortgage of the house are clarified from the two aspects of the mortgagee and the mortgagee;second,the object of the reverse mortgage of the house is clear Scope;the third is to clarify the rights and obligations of the parties to the reverse mortgage of the house;the fourth is to clarify the operating procedures of the reverse mortgage of the house;the fifth is to improve the supporting system of reverse mortgage of housing from the aspects of insurance and real estate;the sixth is to strengthen the government's supervision and management.
