On The Transaction Of C2C Idle Goods In China's Consumer Protection

With the improvement of national purchasing power and the change of consumption concept,the forms of shopping such as single purchase and impulse consumption make individuals have a large number of idle new items in their hands,and the accumulation of goods and the increase of idle items gradually become a practical dilemma.The emergence of idle goods trading platform is just in time.Xianyu,a second-hand trading platform,released a set of data at the strategy release conference held in September 2018.As of that date,Xianyu has 1.1 billion consumers,with a total transaction volume of nearly 90 billion yuan.Shoes,clothing and mobile phones have become the main products in the second-hand market.Compared with the cumbersome seller certification of e-commerce,it is easy and fast to register as a seller on the idle goods trading platform,and the second-hand goods trading is the most typical C2 C online trading mode.Although this new e-commerce mode has the advantages that traditional business does not have,it is difficult to protect the legitimate rights and interests of consumers when their legitimate rights and interests are damaged due to the imperfect legal provisions,government supervision,judicial relief and management of platform operators.Therefore,the protection of consumer rights and interests in C2 C idle goods transaction is still a problem that needs to be deeply studied.In this paper,comparative analysis and case analysis are used to study the protection of consumer rights and interests in C2 C idle goods transactions in China.In addition to the introduction and conclusion,the paper is mainly divided into four parts:The first part is an overview of consumer rights and interests protection in idle goods transactions under the C2 C model.This paper lays a theoretical foundation for the following research by discussing the advantages and transaction process of C2 C idle goods trading,consumers and their rights and obligations in C2 C idle goods trading.The second part is about the problems and causes of the protection of consumers' rights and interests in China's C2 C second-hand goods transactions.The author believes that the problems mainly include the imperfect review mechanism of e-commerce platform operators,the lack of commodity quality assessment services,consumer infringement.And In case ofdisputes,there are some problems such as the retention of evidence and unclear standards for determination.The main reasons are as follows: imperfect laws and regulations,difficult administrative supervision,platform management level to be improved and consumers' awareness of risk prevention and rights are weak.The third part is the experience of consumer protection system of foreign C2 C idle commodity transaction.By using the method of comparative analysis,this paper analyzes the consumer rights and interests protection system and the governance experience of typical cases of foreign C2 C idle commodity transactions,and puts forward some revelations to China.The last part is to improve the protection of consumer rights and interests of C2 C idle commodity transactions,which is the core of the text.The author puts forward Suggestions and countermeasures to improve the protection of consumers' rights and interests in the C2 C model from five aspects: legislation,law enforcement,judicatory,platform self-construction and consumer introspection.Including refining the market classification of trading subjects,strengthening the administrative supervision of prohibited items,improving the litigation mechanism of consumer privacy protection in online transactions,and improving the access system of C2 C idle goods trading platform.
