Research On The Legal Issues Of Supervision Of C2C Idle Trading Platform Operators

In recent years,with the development of Chinese e-commerce industry and the popularization of environmentally friendly consumption concept,idle items trading have gradually moved from offline to online,and developed a series of online idle trading models such as C2 C,B2C,C2 B and C2B2 C.In Chinese C2 C idle trading,there have been some problems such as unclear identification standards of business user,the proliferation of counterfeit and shoddy goods,and the difficulties in resolving users trading disputes.C2 C idle trading platform operator is not only the owner of idle trading platform,but also the organizer and manager of C2 C idle trading activities,It should undertake some supervision obligations and supervision responsibilities for C2 C idle trading activities as important supplement of government supervision.This paper mainly includes six parts:The introduction mainly expounds the background and significance,the research status at home and abroad of this paper.The introduction also expounds the research methods,innovation points and shortcomings of this paper.The first chapter is the theoretical basis of C2 C idle trading platform operator's supervision.Firstly,this chapter introduces the development process and main modes of Chinese online idle trading.Secondly,this chapter defines the concepts of C2 C idle trading and C2 C idle trading platform operator;Finally,this chapter discusses the source of C2 C idle trading platform operator's supervision obligations from the legal status and the theoretical basis.The second chapter expounds the supervision obligations of C2 C idle trading platform operator.They mainly include the platform operator's supervision obligation of platform users,idle trading items,intellectual property infringements,and assistance in resolving platform users trading dispute.Besides,Chinese laws and administrative rules formulate the platform operator's administrative responsibilities and civil responsibilities in detail.The third chapter is the supervision status and problems of C2 C idle trading platform operator.This chapter introduces the legislative status of Chinese platform operator's supervision,and summarizes the realistic problems and their causes based on the reality of Chinese C2 C idle trading platform operator's supervision.The fourth chapter expounds the supervision system regulation of foreignplatform operator such as the USA,the EU,Korea,Singapore,and introduces the classic cases of platform operator's supervision in the USA,France.This chapter make a comparative study on Chinese and foreign platform operator's supervision system regulations and cases.The fifth chapter is the improvement suggestion of C2 C idle trading platform operator's supervision.This chapter put forward some recommendations for Chinese C2 C idle trading platform operator's supervision in legislativeon,administrative and C2 C idle trading platform operator aspect,based on the existingt problems of Chinese C2 C platform operator's supervision and the current regulations of Chinese laws,administrative rules and industry standard.
