A Study On Legal System Of Energy Performance Contract In China

Energy Performance Contracting(EPC)is a new type of energy-saving mechanism in market operation.The EPC has achieved considerable development since it was introduced to China in the 90's of last century.China is very supportive of this.The EPC is a mutually beneficial,comprehensive and long-term civil contract,which belongs to nameless contract as specified by Contract Law.Energy management companies,as the subject of EPC,are those business entities that satisfy necessary qualifications for EPC and of which the business scopes are to provide professional energy-saving services.But at present,its development is faced with problems such as lack of standardization in energy saving service industry,difficulty in financing service financing,reputation risk,low standard level and incomplete supporting measures.This article is divided into five parts,first introduced the concept of contract energy management,and analyzed the development dilemma of China's contract energy management legal system,and made a survey of the United States,European countries,Japan and Russia,which have improved the legal system of contract energy management.On the whole,China should draw on.The above problems and experience are combined to provide solutions.We will improve the energy management system of the contract,play the role of the association according to the development of the system,and actively develop the energy conservation professionals.In order to improve the legal system of EPC in china,We should learn from foreign experience,and perfect the legal system of EPC.This is more conducive to the development of energy saving industry.This paper focuses on the empirical analysis,and makes a thorough investigation on the legislative situation,specific system content and practice of the domestic and foreign contractual energy management legal system.This paper focuses on the empirical analysis and probes into the current legislation of the system at home and abroad.This paper puts forward some Suggestions to solve the heated problems in the academic circle.This article willdiscuss how to improve the energy law.On this basis,we improve the legal system from several aspects.This is more conducive to the development of energy saving industry.
