With the advent and development of the era of big data,the widespread use of high-tech devices such as smart phones and electronic computers has rapidly expanded the virtual(network)space that contains massive data.Such data can be collected and extracted as electronic information and evidence.In the case of duty crimes,most criminal suspects have high social status and hig h comprehensive capabilities.Therefore,forms of duty crimes have become more modern,informationized and concealed.In the context of big data,it is extremely important to explore how to collect electronic evidence of job crimes from a large amount of d ata in the virtual space.In reality,the acquisition of electronic evidence in job crimes investigation is mainly via three common ways,namely,databases,the Internet and electronic devices.This reflects that in the context of big data,the use of elec tronic evidence for duty crimes has the potential to broaden the source of case clues,and help the investigators to maintain correct investigation direction and to quickly break through the deadlock.It also contributes to efficiently integrating survey r esources,restoring the facts of duty crimes,and the protection of rights.However,since the application of electronic evidence in job crimes is still new to many people,there is a lack of attention to it.Insufficient institutional regulations bring ab out ineffective proof.Operational confusion leads to incomplete content of forensic evidence,lack of professional knowledge results in poor evidence,and biased data application causes inaccurate results.In view of the fact that these five issues focus on the evidence-based evidence-acquisition,we propose suggestions for perfecting evidence from the two basic principles that should be followed and the specific path to be improved.The basic principles include the five principles of legality,timely comprehensiveness,professional non-destructiveness,proportionality,and unity.That is,the subject and procedure for obtaining evidence must be legal,the evidence used must be collected in a timely manner,the methods must be professional,the electronic evidence must be intact,and the electronic information must be obtained.The evidence must be reasonable and appropriate,the process of obtaining evidence and the identification operations must be uniform.The specific path includes strengthening the institutionalization of the forensic process,strengthening the normative guidance of evidence-taking behavior,scientifically distinguishing the electronic evidence of the final case and the data related to the case,and strengthening the capacity of investigators to obtain evidence.
