Research On The System Of Exemption From Anti-monopoly

As an important part of the anti-monopoly work of all countries in the world,the anti-monopoly law can play a role second only to the system in anti-monopoly work.Combined with the application of anti-monopoly laws in various countries,the law is mainly used in special industries,which are often closely related to national security,interests,and public domain.Therefore,the anti-monopoly law can play a higher applicability in the national economic development and play an important role in safeguarding national economic security and social public interests.The anti-monopoly law is characterized by strong principles and flexibility.It prohibits monopolistic behavior in the market from the legal level,so as to protect the legitimate rights and interests of other operators from infringement and create a relaxed and harmonious market environment.Thereby achieving the role of promoting the national economy.However,the anti-monopoly law does not completely prohibit the competition monopoly behavior,which leads to the measurement of benefits becoming an important part of the anti-monopoly law.Certain restrictions on competition behavior can not only play a role in promoting competition,but also have exclusion or Negative effects,when the positive impact is greater than the negative one,the anti-monopoly law will exempt the monopolistic competition behavior of some industries,which is also the main cause of the exception of the anti-monopoly law.This paper will conduct a comprehensive analysis on the basis of the current research on the scope of application of anti-monopoly law,so as to understand the principle of the application of anti-monopoly law,and combine the concept of the system to apply the characteristics and value orientation of the anti-monopoly law.The study analyzes the anti-monopoly law formulated by Western countries from the perspective of procedure and content,so as to understand the problems existing in the application of the anti-monopoly law exception system in China and make a reasonable prediction for its future development.The anti-monopoly law for future development needs applies an exclusion mechanism.
