Predicaments And Solutions Of Provincial Prison System's Temporary Execution Outside Prison

Temporary execution outside prison refers to the imprisonment of criminals who are sentenced to fixed-term imprisonment or detention for violation of the law.Because of the situation in accordance with the law,the relevant departments decide to suspend their imprisonment or to serve their sentences outside the prison temporarily after they have been put in prison according to the law.The local judicial organs shall execute the sentences and the judicial community correction department where the grass-roots organizations or the criminals were originally located shall assist them in their imprisonment.The penalty execution system of supervising the execution of sentences.Since its implementation,the system has played a positive role in education,reform and crime prevention,and has achieved good social results.It embodies not only the spirit of legal punishment in China,but also the humanitarian spirit of legal punishment in China.That is to say,"Guarantee freedom and human rights,protect order and security,and realize fairness and justice."^[1]However,due to the influence of various subjective and objective factors in the implementation process,there are still many problems in the early practice of temporary prison execution outside prison,especially the supervision and management problems in the implementation process of medical parole,which occupies an important position,deserve attention because of many disputes.Otherwise,it will not only damage the authority of rigid law enforcement,but also fail to play its due role in the education,reform and crime prevention of criminals,and will have a negative impact on the construction of a harmonious society and a legal society.In addition,some cases that meet the conditions of temporary execution outside prison are difficult to carry out,which is also a realistic problem in the process of judicial practice.There is also the issue of community management after temporary execution outside prison.Therefore,the author discusses the problems and Countermeasures in the judicial practice of temporary execution outside prison,hoping to gain some results.In this paper,the current situation of the implementation of the temporary execution system outside prison is the main research object.It mainly studies the problems and problems in the implementation of the system,the difficulties in the implementation of the temporary execution outside prison,and the difficulties in the identification of the illness after the temporary execution outside prison.Through the phenomena of these problems,we can objectively analyze them,summarize the experience of grass-roots front-line work,and put forward countermeasures to solve these problems,so as to contribute to the implementation of comprehensive rule of law and the construction of a reasonable judicial practice system.There are 1 table,1 figure and 36references in this paper.
