In recent years,after the exposure of the news media,the shocking child abuse incident one piece presented in front of the public.In addition to the traditional parents of young children,the main body of child abuse is now more teachers in pre-school education institutions,they have become the main subject of child abuse reported in the media.The occurrence of child abuse in pre-school education institutions will not only cause great harm to the children's bodies and minds,but also make the image of pre-school education suffer from people's criticism.The lack of legislation has greatly affected the prevention and control of child abuse in pre-school institutions.Although the current stage of legislation also regulates these issues,but unfortunately there are still large omissions in these laws,so that the relevant legislation only stay at the level of principle,can not exert the greatest legal authority.For example,the present stage of our country's legislation on the pre-school institutions of child abuse of the crime and sentencing standards,its appropriateness are to be considered.Child abuse perpetrators can not be effectively blamed,some of the standards of accountability is still uncertain,some accountability system has been formulated but the feasibility is not strong,need to be perfected.At present,china's legislation rarely mentions the prevention of child abuse in pre-school institutions,so that the rights and interests of abused young children can not be effectively protected.The imperfection of legislation has hindered the prevention and control of child abuse in pre-school institutions.In the prevention of child abuse in pre-school education institutions,there are problems such as the imperfection of compulsory reporting system,the blacklist system and the unsound pre-service examination system in our country.In the treatment of child abuse in pre-school institutions,there is also the problem that the crime of child abuse and the punishment of child abuse are still unclear and the compensation for moral damages is not appropriate.On the basis of clarifying the existing problems in the legislation of child abuse prevention and control in pre-school education institutions in our country at this stage,we can combine the advanced experience of extraterritoriality to formulate a system that is in line with our national conditions.Through the inspection of relevant legislation in the United States,Japan and Hong Kong,we can find that the legislation on child abuse prevention and control in pre-school education institutions in these countries and regions started early,and also matured.In the crime and sentencing of child abuse,compulsory reporting system and regulation of the education management personnel,the legislation presents the characteristics of systematization,concreteness and operability.China can learn from its useful experience,from perfecting the compulsory reporting system and strengthening the pre-service examination and behavior regulation of the education management personnel to prevent the occurrence of child abuse in pre-school education institutions.In view of the governance of child abuse,we should start from the two aspects of clarifying the application of child abuse crimes and improving the compensation for moral damages,and improve the prevention and treatment of child abuse in pre-school education institutions in China.
