Preschool education is the beginning of Chinese education system and an important part of the public service system.Since the 18 th National Congress of the Communist Party of China,Chinese preschool education has undergone many reforms,and the educational resources have been expanding.The central and local governments have issued relevant regulations or other regulatory documents.However,it is undeniable that due to the gap between regions and groups,preschool education is still at a shortcoming in our country's educational undertakings.The insufficient supply of public kindergartens,the quality of private kindergartens are worrying,the imperfect government supervision system,and the frequent occurrence of child abuse incidents,all of these problems indicate that the necessity and importance of pre-school educational law have become more and more prominent.The Standing Committee of the 13 th National People's Congress has incorporated the Legislation of preschool education into the national legislative project.The Ministry of Education began to solicit opinions from the society on the draft of the preschool education law in September 2020.This reflects the state's emphasis on legislation regulating the development of preschool education..Ensuring the realization of preschool children's right to education is an obligation that the state should accomplish,and continuous improvement of the preschool education legal system is necessary to promoting the development of preschool education in China.The nature of preschool education,the rights and obligations between different subjects,and administration the regulatory standards of the agency and how to correct the subject's of the rights and interests need to be confirmed and improved by law.Speeding up the legislative process of the "Preschool Education Law of the People's Republic of China" and establishing the basic functional system and investment system in the field of preschool education in China are of instructive significance for the standardized development of preschool education.In addition to the introduction and conclusion,the research on the legislation of Chinese preschool education is divided into the following three parts:The first part is the necessity of the legislation of preschool education in China.The Legislation of preschool education can improve Chinese education legal system,so that all stages of education in my country can be followed;preschool education legislation can clarify the supervisory responsibilities of administrative agencies and avoid situations where governments at all levels lack authorization or prevarication;Education legislation can standardize educational institutions,and on the premise of clarifying the kindergarten system,enable all kindergartens to build various facilities and hire teachers according to standards;preschool education legislation can protect preschool children's legal rights to education,personal rights,etc.,and protect kindergarten teachers The preschool education legislation can clarify the financial investment system in this field,plus the financial investment in the pre-university education field,to ensure that the subsidy of the inclusive park can be in place.The second part is the feasibility of our country's preschool education legislation.This part mainly studies the theoretical foundation,legal foundation and economic foundation of preschool education legislation.First,the state is obliged to provide citizens with more standardized,fairer,and more comprehensive pre-school education;secondly,my country's current laws,regulations and policies provide sufficient accumulation for preschool education legislation,and the legislation of foreign countries also provides my country with experience and For reference,the National People's Congress has also started the drafting of preschool education legislation;finally,my country's growing economic strength can also provide support for preschool education legislation.The third part is the suggestion of advancing the legislation of preschool education in our country.First,it is recommended that the legislature speed up the legislative process based on the release of the draft of the preschool education law(draft for comments)and formulate a good preschool education law;secondly,in terms of legislative content,it is necessary to establish the basic system of preschool education in my country;It is necessary to establish a preschool education investment system in our country;finally,there must be relief for all rights.The legal remedy system for pre-school education in my country must be established to truly protect the legitimate rights and interests of all subjects.In summary,this article hopes to put forward some significant opinions for the "Preschool Education Law" that is in the process of formulation through the study of the current development and legal system of preschool education in our country.
