Analysis Of Technological Protection Measures Of Copyright

The technological protection measures are technical means used by the copyright owners on their works or carriers protected by copyright law.Which has become an important part of modern copyright law and important means to solve the dilemma of copyright protection in the Internet Age,and even lay the basis for other copyright protection models in the future.Therefore,it is necessary for technological protection measures to exist.However,through literature research method,comparative analysis method and case analysis method to analyze the theories,legislative mode and the judicial case of technological protection measures,it can be found that the theoretical basis of current technological protection measures provisions and exceptions aren’t solid.The mechanism of balancing interests is too complicated and not completely compatible with other parts of the copyright law system.As a conclusion,we should reclassify technological protection measures,relocate their positions in the copyright law system,clarify the protect boundaries and improve the limitation and exception clauses,Also,establishing a set of administrative management and administrative law enforcement mechanism is necessary to finally restore the balance between the interests of copyright owners and the public.
