The Research On The Protection Of The Citizen's Labor Rights About The State's Obligations And Social Cooperation Responsibility

The right to work of citizens is the basic right to ensure the basic survival needs of citizens.The discussion on the protection of labor rights is an eternal topic.As one of the basic rights stipulated in the constitution of our country,the right to work is of great significance to the individual citizens,the country and the society.In China's long-term economic construction and social development process,the protection of labor rights has always been in conflict with economic development interests and enterprise management autonomy.Especially in recent years,China's economic construction has entered a new normal stage,the number of labor relations on the Internet platform has increased sharply,and the original labor rights protection mechanism has encountered many challenges.There are more and more deficiencies in the protection of citizens' labor rights,so it is urgent to innovate the mechanism and improve the protection of labor rights.Since the 18 th National Congress of the Communist Party of China,the state has continued to pay attention to the rights of people's livelihood under the new normal of economy,and proposed to innovate social governance,expand social participation and strengthen social coordination.By analyzing the representative labor dispute cases in recent years and the current situation of labor rights protection in China,this paper finds that the government's ability to supervise and adjust labor relations is weakened,which can not meet the current economic development process for the protection of labor rights and the settlement of labor disputes.The government urgently needs the cooperation of other forces in order to better protect the labor rights of citizens.At the same time,the development of the Internet economy has brought about a large number of non-standard labor relations,which has had a certain impact on the protection mechanism of traditional labor relations.It is necessary to introduce the governance mode of social coordination,promote the cooperation of state obligations and society,and form a complementary protection mode of labor rights,so as to better cope with the new labor relations in the context of the new business economy,Relieve the huge labor dispute pressure in China.Of course,the state obligation and the social cooperation responsibility are not substitutes,but complement and support each other.As the basic rights of citizens,the right to work has the functions of subjective benefit and objective value order.The state has the obligation to respect,pay and protect the right to work.Social organizations and employers should cooperate with the state to fulfill their obligations,abide by labor legislation,respect the labor rights of citizens,and give priority to the protection of labor rights between labor rights and management autonomy.Trade unions and social organizations should bear the corresponding responsibility for protecting the rights of their employees and assist in the implementation of national labor protection legislation.In a word,the state and social subjects form a way and mechanism of cooperation within their respective obligations,so as to effectively protect the right to work in the context of the new normal economy.
