Being a new concept of the twenty-first century,big data witness an era of rapid development.The emerging and important concept is promoting social reform and progress.In civil litigation,the emergence of big data means a great challenge to the traditional procedural law.The transformation of the rule of law of evidence is driven by big data.Various big data materials are used as evidence to prove the facts of cases for the more just trial of cases.However,owing to the deficiency and imperfection of relevant supporting rules of the evidence of civil litigation in China,the combination of big data and evidence is unable to bring its value into full play.In practice,there is no clear legislation on the big data evidence of civil litigation.In addition,the acquisition of data information is not standard.And the professional and scientific agencies of appraising big data evidence are inadequate.Finally,the legal application of big data is rigid.Therefore,the legislation on the big data evidence of civil litigation should be made.The acquisition of data information and the establishment of agencies of expertise should be normalized.The legal application of big data evidence of civil litigation and the standards for review and judgment should be made clear and definite.The research of inter-disciplines and the training of talents should be paid attention to.In all,the study of big data evidence of civil litigation will contribute to promoting judicial justice,raising efficiency of litigation,enhancing judicial supervision.Meanwhile,it is also significant to promoting the improvement of the evidence system of civil litigation.
