Study On Risk Assessment Of Recidivism In Parole System

Compared with other penal systems,the parole system is special in that it has a trial period as a buffer,and its positive role is not only reflected in helping prisoners to adapt to the society from imprisonment to return,but also through correction guidance to strengthen and consolidate the previous education and reform of prisoners during this period.However,in the current judicial practice,it is difficult to grasp and operate the substantial condition of "no risk of reoffending" when the parole is requested by the prison.The court lacks effective evaluation on the danger of reoffending;There is no uniform standard when community correction institutions issue the opinion of social impact investigation and evaluation before parole.Aiming at the problems existing in the practice,this paper studies the related academic achievements at home and abroad and combining the basic practice work in prisons,the writer tried to find out in the parole system and risk assessment of crime,and analysed the specific issues in other country parole crime risk assessment experience to perfect China's parole crime again on the basis of risk assessment mechanism has some constructive opinions are put forward.This paper mainly includes four parts,the first part of the article from the legal provisions and practice of the parole system in our country re-crime risk assessment of the status quo;And the second part mainly carries on the thorough analysis to the present parole in the reoffending danger evaluation the concrete question;The third part of the extraterritorial parole on whether the risk of re-crime assessment andreference;The fourth part is the solution of the reoffending risk assessment in the parole system,that is,the conception of improving the reoffending risk assessment mechanism in the parole system.
