On The Perfection Of Parole Hearing System In Our Country

As an important part of our country’s,the penal system has lots of advantages,not only promote positive transformation of criminals,but also conducive to the prison execution cost savings,fit the requirements of open justice.However,compared with other countries’ parole application rate,it’s only 2% to 3% in judicial practice,the parole application rate is obviously low.Some provinces and cities try to enhance the rate applicable on parole,exploring the implementation parole hearing system.This paper is based on the current parole hearing system and author’s internship experience in prison,on parole hearing system made perfect proposal,expected to optimize the existing parole system,to enhance the purpose of parole applicable rate.The first part is the parole hearing system overview.The development of the parole system has been around for a long time,but the use of the hearing system in the review of prison parole is really an experiment.Using parole hearing system in maintaining procedural justice has great significance,including encourage criminals to actively reform,saving prison execution costs and judicial openness.The second part analyzes the status quo of our parole hearing system.Some provinces and cities have made useful explorations on the parole hearing system,but there are various obstacles in judicial practice.No clear legal provisions for parole hearing system carried out in the applicable subject of the hearing,the hearing program content and there are many problems.The third part draws lessons from the foreign parole hearing system.Some countries have directly or indirectly integrated the parole hearing model into the parole system,and its rich experience is worth learning from.Introduced parole and parole hearing systems in the United Kingdom,Canada,the United States,France,and Germany.Taking offenders’ and victims’ rights,incorporating scientific re-offending risk assessment mechanism,hearing procedures for revocation of parole,and community corrections into account.Learn from aspects such as convergence.The fourth part is to improve the parole hearing system.Propose perfect measures in terms of legal basis,applicable subjects,content and procedures,pay more attention to protect criminals’ and victims’ rights,to improve the re-offending risk assessment mechanism,establish hearing procedures for parole revocation,and the connection with community correction system.
