The senior of the company is a group that who is the product of the economic development of our country and the process of the company system development.Different from common laborers,on the one hand,the senior executives represent the company to exercise command and management,on the other hand,they are employed by the company and subject to its arrangement.Therefore,compared with the average worker,the senior of the company have dominant advantages in many aspects,such as higher position,right guarantee and salary and so on.The current labor laws provide indiscriminate protection to the senior of the company,a special group of workers,this is not conducive to protect the legitimate rights of workers at the bottom,but also cannot effectively protect company's benefit?In order to solve this inequality matters more detail and more scientifically,in this paper,the labor dispute cases involving the senior executives in the last four years of the Chinese referee's document networkwere studied in this paper.According to the data analysis,the author found that there is a big dispute between job dismissal and termination of Employment Contract and an employer has to pay the employee an extra two times of their salary if no written form of contacts have been signed by and between both parties.About those problems,the author gives a detail description,and the causes of these problems have conducted in depth analysis.Finally,this paper provide three suggestions on the application of the labor law to apply executives,which are improving legislation,application of law and judicial justice.The author attempted to provide some beneficial reference for perfecting the legislation and the justice.
