On The Perfection Of National Guardianship System Of Minors In China

Minors are not only the hope of the state,but also the vulnerable groups in society.Therefore,it is the common responsibility for the whole society to ensure the safe and healthy growth of minors.However,in real life,there are numerous cases of minors being abused and injured,and minors' physical and mental health has suffered serious trauma.As the "ultimate guardian" of minors,in order to protect the legitimate rights and interests of minors,the state should intervene in time and actively deal with the problems of traditional family guardianship.However,the current national guardianship system of minors in China is not perfect and can not solve these problems well.Based on this,starting with typical cases,firstly,this paper analyzes the problems which exist in the national guardianship system of minors in China,and it mainly manifests these aspects: lack of perfect guardianship supervision system,the national guardianship support system,the national subrogation guardianship system and relevant supporting measures.It also discusses the necessity of perfecting this system.Secondly,this paper also analyses the theoretical basis of the national guardianship system for minors,which embodies in two aspects: the theory of state parental rights and the theory of state responsibility.Finally,drawing on the mature experience of foreign countries and combining with the basic national conditions of our country,this paper puts forward some suggestions for the perfection of this system,such as establishing the basic principles of national guardianship system of minors in China,perfecting the national guardianship supervision system in China,perfecting the national guardianship support system of minors in China,and the national subrogation guardianship system of minors in China,and perfecting relevant supporting measures.Hope these suggestions protect the healthy growth of minors and promote the harmonious and stable development of society.
