About The Artificial Intelligence For Court Decision In The Perspective Of The Development History

With the development of artificial intelligence technology,the application of artificial intelligence law has come into being,but there is controversy about what position it should be in the court decision.Based on the actual effect and predicament of the application of artificial intelligence law and the demand of judicial decision,this paper discusses the gap between the two,and demonstrates the conclusion that the application of artificial intelligence law should be positioned as the auxiliary status in the court decision at the present stage.COMPAS system is currently the United States federal and some state courts are running the most advanced artificial intelligence legal application,its design produced and implemented in the United States quantitative sentencing era at the end and the two-track sentencing era of the historical background,from the point of view of operational mechanism,it based on criminological principles and empirical Big Data summary set evaluation factors,The factors are also linked to the risk level,and the conclusion is obtained on the risk degree of the assessment object,which guides the court sentencing.This application seems reasonable from the technical point of view,but there are many controversies and dilemmas in the process of application,the more typical example is the Loomis case.At present,there are many needs in the judicial decision,such as the logical cognition of judges,the ability of comprehensive rationality,the experience and empathy,as well as the certainty of case trial and the construction of judicial credibility,and the application of artificial legal intelligence is obviously not satisfied,and there is a gap between the two.In order to bridge this gap,we should start with the quality of judicial data and gradually promote the development of the application of artificial intelligence law under the premise of reasonable orientation.
