Legal Framework On Foreign Investment In Lao PDR: The Case Of Investment In Concession Business

This thesis focuses on the legal aspect of foreign investment concerning concession business in Lao People?s Democratic Republic(Lao PDR).The type of investment in concession business,it base on the compulsory principles of laws and regulations to implement the government to administer and protect the foreign investors to invest in Laos.The main aim of Lao PDR,in this regards,is to enhance benefits and role of investment for continuous and sustainable socioeconomic growth,and significantly contribute towards national security and development of the country.This study firstly provides overview of laws concerning investment in Laos,and then examines legal framework for investment,the administer and protection of foreign investment in Laos,it also examines the law-making process as well as the quality of the country?s investment policies and level of legal protection granted to both domestic and international investors.There are national laws,international laws,and international treaties that are relevant to the foreign investment which is the legal basis of studying and defining foreign investment in Laos.These are very necessary and important factors to improve legal system of Laos and welcome foreign investors.The administration and protection of investment in concession business is specified in the provision implemented and enforced by the Law on Investment in 2016.Laos has the decree on the implementation of the investment promotion law,Land law and decree on state land lease or concession in order to make investors invest in the country.Moreover,Lao PDR has the economic cooperation with various countries in the world by signing investment agreements,especially with China.These laws and regulations are the principles and measures to protect the investment of foreign governments and investors.This thesis provides a clear understanding of the factors that influence foreign investment and that may determine the future trends in such investment.This paper assesses the effects of investment laws and regulations on foreign investment flows in Laos,and takes ideas on theory and practice from the investment law of China which can be very useful for investment law and legal regime of Lao PDR.
