Research On Protection Of Telecom Consumers' Rights And Interests

By the end of 2019,China has fully implemented Number Portability and further promote the policy of speeding up and reducing fees.The implementation of the two policies has attracted wide attention from the public.Telecommunications industry is the basic industry related to the national economy and people's livelihood.In recent years,China's telecommunications industry has experienced many reforms.Telecommunication services have spread to thousands of households,infiltrated into all aspects of social production and life,and brought great convenience to people's life and social production.With the continuous development of telecommunication technology and the increasing number of service types,the policy of Number Portability and speeding up and reducing fees has been deepened.The positive effects have been widely praised.But consumers' make complaints about telecommunication services are becoming more complicated.In addition,some problems in the implementation of policies have led to deeper thinking.The protection of telecom consumers' rights and interests is more concerned by all walks of life.At present,there is still room for strengthening the protection of the legal rights and interests of telecom consumers in China.There are some loopholes in the system.In order to further improve the protection system and strengthen the protection of the rights and interests of telecom consumers,this paper systematically combs and studies the protection system of the rights and interests of telecom consumers in China by taking the opportunity of the policies of Number Portability and speeding up and reducing fees.Firstly,this paper summarizes the background,current situation and significance of the research on the protection of telecom consumers' rights and interests,and clearly adopts the research methods.The second chapter begins with the conception and definition of the telecom consumers,legalizes the concept of the telecom consumers,and then analyzes the special rights and characteristics enjoyed by the telecom consumers,highlights the social welfare,irreversibility and human rights of the special rights and interests of telecom consumers,and points out the important significance of protecting telecom consumers,which lays the theoretical foundation for the discussion of the later part.In the third chapter,the author combs the current situation,the latest progress and the existing problems of the protection of the rights and interests of telecom consumers in China,analyzes the current situation of the protection of the rights and interests of telecom consumers by the current laws and regulations and the implementation of the policies of Number Portability and speeding up and reducing fees,from which the author analyzes the problems of the protection of the rights and interests of telecom consumers in China: insufficient legislative regulation,lack of effective competition in industry monopoly,government supervision to be strengthened and private remedy to protect the rights and interests of telecom consumers to be improved.The fourth chapter turns to the foreign perspective,studies the representative telecommunication industry developed telecom consumer rights and interests protection practices in the United States and the United Kingdom,summarizes the emphasis on legislative protection,independent supervision,attention to mechanism improvement of useful experience.Finally,based on the analysis of the problems,the fifth chapter puts forward the reform measures suitable for the development of China's telecommunication industry from five levels: strengthening the industry legislation,standardizing the management of telecom service contracts,strengthening the competition and government supervision of the telecom industry,improving the self-discipline and social supervision mechanism of the industry,and improving the relief mechanism of telecom consumers' rights,so as to provide a more complete system for the protection of telecom consumers' rights and interests.
