Land is the mother of wealth,non-renewable property and ecological resources.The land is different from the general commodity,which is the special commodity form,that the necessity of the country should carry on the regulation to its circulation is self-evident.In 2020,with the implementation of the newly revised Land Management Law,the legislative shackles that hinder the entry of collective operating construction land into the market were broken,which marched from pilot to practice.In this paper,we takes the regulation of the administrative law on the entry of the collective commercial construction land into the market as the research object,and obtains the regulatory requirements of the administrative law on the entry of the collective commercial construction land into the market on the basis of the study and exploration of the administrative law by combing the relevant legal norms in China,analyzing the experience at home and abroad and drawing on the views of experts and scholars.This paper is divided into three parts for analysis and demonstration.The first part introduces the concept and standard basis of collective management construction land.First of all,by discussing the relevant concepts and meanings,it clarifies the difference between collective management construction land and other types of land,and then get the special points of this work into the market,so as to facilitate the follow-upstudy.Secondly,the paper analyzes the normative and practical basis of collective management construction land,and explains the necessity and feasibility of this work.The second part introduces the dilemma of collective management construction land entering the market,which mainly discusses the dilemma of land use control,the dilemma of unclear ownership of collective land,the dilemma of imperfect market entry system and the dilemma of difficult supervision.The third part puts forward the path of administrative regulation system based on the first two parts.Combined with the practical work of local administrative departments,this paper puts forward specific regulation opinions from four aspects: land planning,land confirmation right,entry procedure and overall supervision.
