A Study On The Substantive Examination In The Registration System

Combining with the background of the reform of the registration system in China,this paper begins with the establishment of a correct concept of case review,through the in-depth analysis of the legal and theoretical aspects of the form review and the substantive examination,as well as the changes of the filing and examination system before and after the reform,and summarizes the background of the reform of the Register system The Uniform rules and measures to be followed by the people's Court in judicial practice should be grasped in order to provide some valuable reference for the orderly examination of the case,so that the reform of the registration system can truly achieve the initial legislative purpose at the top of the design.This paper is divided into five parts: the first part is to study the paradox and orientation of the substantive examination under the filing and registration system.The second part explains the theoretical basis of introducing substantive examination into the registration at the present stage.The third part focuses on the experience of introducing substantive examination into the registration of cases.This part analyzes the problem of the interpretation of the case,and in the legislation,the Mingquan of the judge to exercise the interpretation in the examination work is only in principle,lack of specific matters,content and scope of the provisions,so it enumerates the main practices in practice and carries out the corresponding analysis.The fourth part is the frontier comparison and reference of foreign filing and registration examination.The fifth part is the substantive examination boundary and technical route in the registration of the case.This paper mainly summarizes the correct ideas and rules to be followed in the practice of filing a review from three aspects,grasping the limits of the case and reviewing the case,so as to make the reform of the registration system more legislative.
