Study On Prosecution Recommendations System For Protecting Minors

Minors are the future of the country.Protecting the healthy growth of minors is related to the happiness of millions of families and the rejuvenation of the Chinese nation.In recent years,procuratorial organs have stepped up their efforts in uninspected work,giving full play to the superiority of the procuratorial recommendation system,and in practice have achieved the organic unification of the legal and social effects of protecting minors ’rights and interests.Proceeding from the current operational practice in China,this article actively explores the current operational status of prosecutorial recommendations for the protection of minors in China.In addition to the introduction and conclusion,this article will conduct a study from the introduction of the protection of minors’ prosecution recommendations,institutional value analysis,type analysis of practical samples,operational problems and improvement measures.The first part,through the analysis of different doctrines of procuratorial recommendations,explained the concept of procuratorial recommendations more comprehensively,and further explained the concept of protecting procuratorial recommendations of minors.Through the elaboration of the concept,historical evolution,characteristics and basic procedures of the procuratorial recommendations for the protection of minors,a legal analysis of the procuratorial recommendations for the protection of minors is conducted.The second part is to analyze the value of the system to protect minors’ procuratorial suggestions,and to explore the necessity of procuratorial suggestions in the minor’s procuratorial work.First,the application of procuratorial recommendations can effectively implement the concept of special protection for minors;second,the procuratorial recommendations are a flexible embodiment of the special supervision function of the procuratorial organs;finally,the uninspected departments participate in comprehensive social governance through the procuratorial recommendations,which is conducive to improving the level of national legal governance.The third part analyzes the sample of prosecutors’ suggestions for protecting minors in China.Analyze the application of minors’ prosecution recommendations in cases of abuse of caregivers,school bullying,indecent sexual assault of children,and revocation of guardianship cases,and summarize the key difficulties in applying the prosecutorial recommendations in order to protect the minors.Good for national minor protection work.The fourth part,through analyzing the current situation of the protection of minors,the suggestions in practice are in the form of suggestions,the feedback is not timely,and the assessment criteria are based on one-sided and disjointed links,which leads to the protection of minors.Suggestions are lack of rigidity,low quality,and difficult implementation.The fifth part discusses the comprehensive measures of procuratorial suggestions for juvenile protection,aiming to improve it from the perspectives of standardization and effectiveness,and to realize its positive role in promoting the stable development of comprehensive social governance,by ways of normalizing the types of procuratorial suggestions for juvenile protection,the procedures and methods of implementation,improving its inner quality,establishing supervision evaluation mechanism and third-party review communication mechanism.
