Research On The Administrative Factual Act In The Public Security Administrative Adjudication

In China's administrative law,the theory of administrative factual act and administrative legal act constitute the theory of administrative act.Along the way,the theory of administrative juristic act "makes great progress" and occupies an absolutely important position in administrative law.The theory of administrative factual act develops late and progresses slowly,which has been in a relatively weak position.With the development of the rule of law in China in recent years,more and more scholars have paid attention to the act of administrative fact.On this basis,the relevant theories have been further developed and improved.But at present,there are still many blank areas which are not involved by scholars,which actually hinders the development of the theory and practice of factual behavior.In this context,the author chooses one of the important areas of public security administrative adjudication to study the administrative factual act,expecting to make a little contribution to the further improvement of the theory and practice of administrative factual act.In the first part of this paper,through the interpretation of the basic theory,the author explains the meaning of the relevant concepts of public security administrative adjudication,administrative factual act,and administrative factual act in public security administrative adjudication,which lays a theoretical foundation for the writing of this paper.The second part classifies the administrative factual act in the public security administrative adjudication by different standards,and expounds the specific content of the administrative factual act in the public security administrative adjudication.In the third part,through the tabulation of the contents of the factual act in the public order ruling,the exit and entry ruling,the assembly and demonstration ruling and the traffic management ruling,the readers can directly feel the general and specific performance of the factual act,and further show the important function and value of the factual act.The fourth part analyzes the current situation of the administrative factual act in the public security administrative adjudication to find the existing problems and their causes.The fifth part puts forward concrete and feasible standard measures for the corresponding problems.
