The popularity and development of Internet information technologies such as big data and cloud computing have completely changed traditional payment methods,and online consumer finance has undergone radical changes.At present,as one of its important branches,the Internet consumer credit business has also been formally launched in major e-commerce platforms,with attributes similar to virtual credit cards,which has greatly enhanced people's ability to pay for consumption.At the same time,the use of consumer credit products to cash out is endless,mainly manifested by the actor's "collusion" cash,"fake" cash and "organizational" cash for the purpose of illegal possession,which makes the criminal objective behavior The complex state of affairs has led to a qualitative divergence of the same illegal behavior in judicial practice.At present,there are relatively complete laws and regulations on the crime control and judicial crackdown of credit card cashing.However,how to properly use legal methods to effectively regulate the criminal behavior of cashing on e-commerce platform online credit products requires further in-depth study.This thesis analyzes and demonstrates from the perspective of the cash-out of consumer credit products on e-commerce platforms in China.It selects the typical cases of current behaviors in the openlaw adjudication document network as a research template,and sorts out and discovers that the current situation of consumer credit product sets on e-commerce platforms may be triggered The focus of the controversy,explain and demonstrate the crime and non-sin of the current behavior,the relationship and difference between this crime and the other crime.It is conducive to curbing the growing crime trend,and has important theoretical and practical significance.The main content of this thesis consists of four chapters.The first chapter analyzes the concept,operating mechanism and legal attributes of online credit products,sorts out the legal benefits involved and related legal elements,and introduces the legal risks that exist;Part of it is the investigation of the judicial status of cashing out consumer credit products on e-commerce platforms,analyzing themain types of current behaviors,the nature of arbitrage,and the trial dilemma.The third part analyzes the jurisprudence of the three different types of cases by combining typical cases;the fourth part is the comprehensive text,which draws on foreign useful experiences and puts forward suggestions for criminal regulations.
