Research On Short Video Clips And Fair Use System In Copyright Law

With the in-depth development of digital applications and the popularity of smart mobile terminals,the short video industry,which is a new thing,has grown rapidly and has attracted the attention of a large number of citizens.But at the same time as its booming development,the problem of copyright infringement also came along and became increasingly prominent.A large number of short video works can be easily and quickly copied,and can be forwarded,edited,and adapted at will,which seriously damages the copyright owner's legitimate interests,and blurs the boundary between infringing use and fair use.At the same time,it has a great impact on the system of fair use in the traditional environment.Therefore,It is necessary to study and discuss the fair use system in short video.The full text is mainly divided into the following five parts:The first chapter studies the overview of short video editing and copyright fair use system.The second chapter analyzes the challenges brought by the development of short video industry to the fair use system from different perspectives.The development of short videos has largely changed the dissemination form and scope of works,breaking the balance of reasonable use.Blurring the boundary between proper use and infringement makes the traditional fair use system face confusion and challenge.The third chapter introduces the debate on the preservation and abolition of the system of reasonable use in the field,and expounds the necessity of the existence of the fair use system in detail from three aspects: Philosophical investigation of law and the economic analysis and the Constitutional analysis of the fair use system.The forth chapter mainly introduces the legislation of international conventions,individual typical countries and the Taiwan region of China on the rational use of copyright in the network environment,so as to bring reference to the improvement of the reasonable use system in China.The fifth chapter puts forward some countermeasures to improve the system of fair use of short videos by combining with foreign experience and starting from several aspects such as legislative concept,legislative mode,judgment standard,platform responsibility and industry supervision.
