Research And Enlightenment Of Legal Philosophy Thoughts In Marx's "Critique Of Hegel's Philosophy Of Right"

The thought of philosophy of law is an important content in the treasure house of Marxist thought.Looking at the history of the development of Marxist philosophy,we can see that its philosophical thought originated from the thought of philosophy of law.As an early work of Marx's philosophy of law,Hegel's Criticism of Philosophy of Law(hereinafter referred to as Criticism)contains abundant thoughts of philosophy of law.Therefore,a comprehensive and profound grasp of Marxist philosophy of law plays an important role in improving Marxist theory.At present,socialism with Chinese characteristics has entered a new era,and the construction of the rule of law has made new achievements,but also faces challenges.It is more necessary to study and grasp Marx's philosophy of law,solve the problems of the construction of the rule of law in the new era,and lead the further development of the construction of the rule of law in the new era.Through sorting out the theoretical sources of Marx's philosophy of law and its early transformation,this paper deeply understands the connotation,characteristics and essentials of the philosophy of law in Criticism,and combines with the reality of the construction of rule of law in our country in the new era,puts forward realistic value guidance and practical reference for the construction of rule of law in the new era.The paper is divided into four main parts.The first part is the introduction,which mainly introduces the reason of selecting the topic,the significance of the research and the research status at home and abroad,and analyses the research ideas and methods of this paper.The second part is the first chapter,which is "the origin of theory: the theoretical origin and early evolution of Marx's philosophy of law".Firstly,this paper combs the main historical origin of Marx's philosophy of law,mainly divided into two sources: Kant's philosophy of right and Hegel's philosophy of law;in addition,it combs Marx's philosophy of law.The early evolution of the philosophy of law clarifies the early evolutionof Marx's philosophy of law and provides support for the understanding of the philosophy of law in Criticism.The third part is the second chapter,which is "the nature of thought: the basic viewpoint of the legal philosophy thought in Hegel's Criticism of Legal Philosophy".This part mainly expounds the main content,main characteristics and core essentials of Marx's legal philosophy thought in Criticism,so that it can be clearly presented.The last part,the third chapter,is "the lesson of thought: the new value of Hegel's Criticism of Legal Philosophy ".This part,based on the analysis of the reality of China's legal construction in the new era,grasps the achievements and shortcomings of China's legal construction,and combines with the legal philosophy of Criticism,analyses and mentions them.Put forward the reference and enlightenment that Criticism can provide for the construction of rule of law in the new era...
