Study On The Regulation Of Private Law Of Shared Accommodation In China

With the continuous improvement of Internet technology level,it is bound to spark off economic development.At the same time,the State advocates "Internet plus" policy and the sharing economy arises at the historic moment.As a new economic model,sharing economy breaks the existing economic system.Sharing economy takes the network platform as the basis,which can effectively promote the matching of supply and demand,activate idle resources,and realize the direct exchange of goods and services between individuals.In recent years,the sharing economy has triggered a global upsurge.As an important branch of the sharing economy,the sharing accommodation has also attracted much attention.At the same time,people's enthusiasm for tourism,the development of the Internet,and the support of national policies all make the development of shared accommodation more and more strong.Shared accommodation is of great significance to the promotion of national economic development.The strong development trend does have a great role in promoting China's economy,but the development of shared accommodation is not without benefit.Nowadays,the development of shared accommodation industry has its new characteristics,but the existing regulatory system in China can not adapt to a certain extent.There are many problems in the development process of shared accommodation,but there has been a lack of unified and special legal documents for regulation.Shared accommodation is a new type of accommodation mode based on the Internet,and the traditional legal relationship of accommodation is no longer applicable.In order to respond to the policy call,we need to strengthen the supervision of shared accommodation,not only to speed up the improvement of the normative legal documents regulating shared accommodation,but also to give play to the combination of industry self-regulation.However,at present,there is no law to regulate the shared accommodation industry,and the theoretical circle lacks of research on the private legal relationship of shared accommodation.It is unable to define the legal status of the main body of the shared accommodation,and it is also unable to define the rights and obligations among the main body.As a result,there is no measurement standard and theoretical basis when the judicial department judges disputes,and it is difficult to make a correct judgment.Therefore,it is necessary to study the legal relationship of shared accommodation.Starting from the characteristics of shared accommodation and the challenges encountered in the development process,this paper analyzes the private legal relationship involved in the transaction process of shared accommodation,finds out the basis of legal regulation through classification analysis,and provides theoretical support for the promulgation of normative legal documents.I hope to provide constructive suggestions for the improvement of legal documents and regulatory system through this study.
