The Civil Law Protection Of Personal Information In Big Data Environment

With the development of big data environment,the new term "big data" is slowly floating in front of the public.The big data environment makes personal information become an important resource.However,the security protection of personal information also limits the use of personal information and restricts the development of the big data environment,so we must have a reasonable way to solve the problem of personal information security protection in order to make big data and information flow freely like food and capital and other production factors.The security protection of personal information in big data environment mainly includes two aspects: personality and property.Developed countries have always attached great importance to the protection of personal rights,especially the improvement of relevant laws and regulations for personal information security protection.Big data has a broad application prospect,but the security protection of personal information in China is lack of legal norms.The security protection of personal information is mainly a civil law problem.The rules of personal information security protection at the civil law level in China are almost blank,so a new civil law protection system of personal information needs to be built in the big data environment.Based on the study of the characteristics of big data environment,this paper analyzes in detail the problems faced by the civil law protection of personal information in China,and from the perspective of civil law protection,drawing on the experience and lessons at home and abroad to find a basic path in line with China's national conditions.This paper analyzes the characteristics of big data environment and its impact on the civil law protection of personal information.From the analysis and comparison of the legislative systems of the relevant typical countries,we can get the enlightenment.At last,we get the ideas and suggestions of personal information security protection from civil law.The main body of thispaper is divided into five parts:In the introduction part,the author puts forward the research questions,research topics and scope,and summarizes the purpose and significance of civil law protection of personal information in big data environment.The first chapter introduces the basic overview of big data and personal information,especially the definition of personal information protection in big data environment.The second chapter introduces the current situation and shortcomings of civil law protection of personal information in big data environment,which is a major focus of this paper.It mainly analyzes the current situation of civil law protection and judicial protection,and finally finds out the shortcomings of civil law protection of personal information.The third chapter introduces the legislative system of the civil law protection of personal information in some typical countries and makes a comparative study of the legislative experience of the main countries concerned,in order to find a way that conforms to the national conditions of our country.The fourth chapter introduces the Countermeasures of civil law protection of personal information in the big data environment,mainly from the new trend of civil law protection of personal information,the right positioning of personal information,the determination of the principle of presumption of fault and other aspects to introduce some ideas of civil law protection legislation.
