Research On Civil Legal Subject Status Of Artificial Intelligence

Whether we rejoice or hesitate,we are about to enter a whole new era--the era of artificial intelligence.While people are full of curiosity about artificial intelligence,artificial intelligence is also constantly integrating into every aspect of people's life,showing extraordinary achievements in various industries and fields such as medical care,education,consulting and transportation.At the same time,the wide application of artificial intelligence has also caused a series of practical legal issues.In order to deal with the challenges that artificial intelligence may bring to the law,we should consider that artificial intelligence should be brought into the legal context.Legal status is the foundation and core of legal research.Since artificial intelligence is more involved in a wide range of civil activities,it is more specific and necessary to discuss the civil subject status of artificial intelligence.This paper is mainly divided into the following four parts to analyze and discuss this problem:The first part gives a brief introduction to the concept,classification,characteristics and development of artificial intelligence,and divides artificial intelligence into two types,strong and weak,based on the different intelligence degree of artificial intelligence,which paves the way for the later discussion.By analyzing the impact of artificial intelligence on social security and legal liability system,this paper points out the reasons for studying the civil legal status of artificial intelligence.The second part introduces the civil legal subject system,including the development of civil subject,the standard of judging civil subject,etc.It is pointed out that having independent will is the essential requirement to become a civil subject,so as to analyze the possibility of artificial intelligence becoming a civil legal subject.The third part based on the classification of the above,analyze the weak civil main body status of strong artificial intelligence and artificial intelligence,it is concluded that the weak ai does not have civil main body status and strong ai has the civil main body status.This paper focuses on the analysis of strong artificial intelligence and puts forward the necessity of giving it civil subject status and the limitation of subject status.The fourth part is the forward-looking thinking on the civil subject status of artificial intelligence,including how to gradually clarify the civil subject status of artificial intelligence from theoretical research to policy guidance and finally to legislation,and how to make artificial intelligence play a better role in society by establishing and improving the corresponding normative system and improving the citizen's ethical concept.
