The Dilemma And The Way To Deal With The Innocent In Criminal Cases

Since the 18 th National Congress of the CPC,with the deepening of the reform of the judicial system,a large number of unjust,false and wrong cases have also begun to surface.The public in the question of judicial justice,regret the innocent at the same time,but also began to think about this problem.The aim of criminal procedure is to fight crime and protect human rights,so the mechanism of innocence is the institutional arrangement to protect human rights.In the judicial practice,the operation of the innocence processing mechanism is not in its proper state,and the exit of innocence is not unimpeded.Incomplete implementation of the acquittal Presumption of innocence,blocked exit of acquittal and improper application of standards of proof in criminal proceedings are several factors affecting the functioning of the acquittal mechanism.The way out to improve the plight of the innocent handling mechanism in the current judicial practice should also be found out from the above factors.
