Research On Compulsory Indecency And Insult Crime

Influenced by China's feudal ideology,people felt uncomfortable talking about sex over the years.But with “other times and other manners” and the rapid development of our society,people's attitude towards sex has also undergone great changes,and "homosexuality","bisexual" and other groups are increasing and being accepted.While the concept of sex is being emancipated,the male sexual rights are being violated frequently.In order to further protect the sexual rights of men,the Criminal Law Amendment(9)amended the crime of compulsory indecency and insulting women,to include the sexual autonomy of men over the age of 14 in the protection category of the crime of compulsory indecency,which makes up for the deficiency to some extent of the difficulty for men over the age of 14 to get judicial protection when they are sexually assaulted.But after amendment there are still some defects in the crime of compulsory indecency and insult,e.g,distinction of the crime of compulsory indecency and insult from other crimes;the circumstances that should be paid attention to in determining the crime of compulsory indecency or insult;and relatively vague statutory penalty setting.In order to solve such problems,this paper takes the "Study on the Crime of Compulsory Indecency and Insult" for the topic,and puts forward some suggestions to improve the legislation based on the analysis of the main characteristics of the crime and the study of the determination of the crime.This paper consists of four chapters as follows:Chapter 1 discusses the definition and legislative evolution of the crime of compulsory indecency and insult.This chapter first defines the definition of the crime of compulsory indecency and insult,and then expounds the legislative changes of this crime over the years.Chapter 2 analyzes the main characteristics of the crime of compulsory indecency and insult.This chapter analyzes the crime of compulsory indecency and insult from aspects of the criminal object,objective conditions,subjective aspects,to provide theoretical basis for further determination of the crime.Chapter 3 discusses the determination of the crime of compulsory indecency and insult.This chapter mainly involves three parts: the distinction between the crime of compulsory indecency and insult and other crimes,the identification of the form of quantity of crime and the problems needing attention in the identification process.Chapter 4 is about the legislative perfection of the crime of compulsory indecency and insult.This chapter first theoretically analyzes the crime of compulsory indecency and insult from the legislative aspect,and then puts forward improvement suggestions for this crime from two aspects of description of the crime and statutory penalty setting.
