Legal Regulation Of Police Power In The Era Of Big Data

With the rapid development of Internet information technology,the Internet is gradually going deep into our daily life and providing many conveniences for our life.At the same time,there are many cases of using cybercrime.When fighting this type of cybercrime,public security agencies will use the big data technology to find relevant clues.Besides,the booming development of big data and big data technology has also provided great help for police officers in dealing with traditional cases,such as case prediction,evidence collection.However,from the police data mining,collision,analysis and prediction,to the use of big data technology to combat and prevent crimes,there may be power anomalies,which harms society.Therefore,to ensure the good operation of police power in the era of big data,the laws and regulations of police power are essential.In the era of big data,the exercise of police power has more multiple attributes,such as limiting personal freedom of citizens,depriving civil property,etc.This has led to the emergence of predictability,and it is more inflated,intrusive and other new features,so the legal regulation of police power in the era of big data is very necessary.The author believes that to study this,we must first have a comprehensive understanding of the concept and characteristics of big data,and then understand how the public security organs exercise police power in the era of big data.Mainly,this paper is divided into five chapters for discussion.The first part briefly introduces the research background,research significance and current situation.The second part starts with the police power in the big data era,discusses the relationship between big data and police power,and elaborates the new changes,operating forms and values of police power compared with traditional police power in the big data era.The third part is the combination of theory and cases.Analyze the cases of exercise of police power in the current era of big data.It mainly discusses from the aspects of weak concept of power subjects,ownership of police data responsibility,network supervision and big data investigation.The fourth part analyzes the causes of the problems discussed in Chapter Three,and explores the main reasons are the current imperfect legislation,inadequate implementation of the system,incomplete supervision system,and limited parties' right of remedy.The fifth part is to improve the legal regulation of police power in the era of big data in China.Explain in terms of formulating internal regulations to train police officers on big data awareness,putting forward suggestions on legal gaps,strengthening the implementation of existing systems,strengthening internal and external supervision and expanding the relief channels of the parties.
