The Reflection Of Our Country's Police Power Regulation

With the development of China's economy and the improvement of the rule of law,police power has played an important role in safeguarding the legitimate rights and interests of the masses and maintaining social stability and harmony.Because of the influence of personality weakness and defects of power,the power of the police in the legal practice to show unilateral and mandatory features,the abuse of police power from time to time also caused a bad social impact,therefore,in order to guarantee the good operation of police power,the laws and regulations of police power regulation is essential.In today's society,the idea of rule of law and the concept of rule of law are carried out in the whole process of national governance,and the restriction of public power has become the core concept of the country under the rule of law.The construction of a harmonious socialist society cannot be divorced from the core idea.In fact,it is necessary to set up relevant system to make sure that our citizens are in the right defining society.The specific way of regulating the police power can proceed from the right to run the program of legal system,the police and police power allocation,the operation mode of the police power to a country under the rule of law ideal type of police power operation mode closer,and eventually realize the police the right to protection of the rights of citizens utility.In view of this,this paper makes a thorough discussion on the legal regulation of police power,based on the perspective of administrative law and constitution.This article is divided into three chapters.The first chapter through the case of police power regulation of the consequences of the lack of legal regulation,Dilemma and analysis of China's current situation of our country and the exercise of the right of the police police powers,including the power system vulnerability of police,police power anomie,administrative remedy for three problems.The second chapter expounds the related theory of police power regulation and its necessity,analyzes the plight of the police power of legal regulation,mainly includes four aspects:the legislation of police power is not perfect,the police power is unreasonable,the exercise of police power by external interference and supervision mechanism of police power shortage.The third chapter is the construction of the rule of law in the regulation of police power in China.It mainly adopts four measures:improving the police power legislation,scientifically configuring the police power,improving the supervision mechanism and improving the relative rights relief system,so as to strengthen the legal regulation of the police power.
