Study On The Performance Of Disputes In Computer Software Development Contract

With the rapid development of China's science and technology industry,the number of disputes over the execution of computer software development contracts in judicial practice has increased rapidly,but academic research on such disputes has lagged.Due to the immateriality of computer development results in the complexity of technical results as commodity exchange,how to determine whether the software developer has fulfilled the contractual obligations has become a difficult issue in the dispute decision of the software development contract.This paper will study the disputes in the performance of computer software development contract from the method of case empirical analysis.It was found that there were problems in determining performance,such as cutting off additional obligations,vague acceptance criteria,and disputes during the performance period.The main reasons for these problems are the imperfect dispute resolution mechanism,vague technical appraisal rules,unclear acceptance standards,and relevant legal bodies The Department is not perfect and the enterprise lacks certain legal knowledge.In order to make up the deficiency,the article makes some proposals for the procedure,and provides some ideas for resolving disputes in the performance of computer software development contracts.
