Research On The Civil Legal Relationship Of Infringement Caused By Automated Vehicles

Under the background of big data,artificial intelligence(AI)technology has been developed unprecedentedly,thus deriving the self-driving car products.AAA classifies it according to its automation,the self-driving cars mentioned in this article belong to level 3 to level 5,including conditional automation and complete automation.The aim of developing self-driving cars is to create a better life for us.As a new type of vehicle,the emergence of new things is often accompanied by a series of legal relations,Whether the new legal relationship can be applied to traditional legal relations still need to be discussed.Some developed countries(such as Germany,the United States,Japan,etc.)have issued relevant laws,regulations and policies.At present,China has only issued guidance on self-driving cars,which is hard to adapt to the above trends.We also know technology is a double-edge sword,self-driving cars bring us great benefits,but also some challenges,especially the impact on traditional laws.For example,traffic accidents caused by self-driving cars will lead to some changes in traditional tort laws,including the tort subject,the civil tort principle of imputation,tort types,etc.Or,as self-driving becomes safer,the current insurance industry model will make new adjustments,as well as the changes of relevant compensation and relief policies,which are all factors we need to consider.The theme of this article is self-driving car,the full text is divided into five parts: the risk of automatic driving?the subject of tort liability of driving cars?the type of self-driving infringement?the tort principle of imputation?the compensation and relief.This paper analyzes the influence and challenge of the products under the artificial intelligence technology to the current tort law of our country,and puts forward some ways to perfect the compensation and relief for the traffic accident caused by the self-driving cars.
