Research On The Identification Mechanism Of The Network Fund-raising Of Serious Illness

Network donation for serious illness is a new mode of donation in the network era,which effectively makes up for the shortcomings of traditional donation and medical security system,provides financial support for the poor groups to seek medical treatment,and is the main output channel of social public welfare.The convenience and low cost of Internet fund-raising for serious illness make it necessary for countless helpseeking projects to raise funds online,an effective identification mechanism to intercept and deal with all kinds of illegal behaviors in time,maintain the order of fund-raising,and ensure the orderly development of fund-raising.This paper reviews the development of Internet fund-raising for serious illness and finds that it mainly relies on three types of Internet platforms,and the legal characteristics of fund-raising projects on different platforms are different,which constitutes the differentiation of public and private fund-raising in the mode of fundraising,and ultimately directly affects the applicable legal norms,as well as the operation effect of the recognition mechanism.The existing identification mechanism is based on the network platform and social public opinion,which plays a certain role in identifying unqualified fund-raising projects.However,the frequent occurrence of various kinds of network fraud events also declares that there are certain loopholes in the identification mechanism.The identification mechanism is limited by the fundraising project itself,which not only has the identification failure to the existing project,but also does not make a reasonable extension before and after the fund-raising link,resulting in the lack of identification before and after the link,and unable to give full play to the technical advantages of network fund-raising.In order to deal with the problems of the recognition mechanism,this paper,guided by social rights,contractual spirit and welfare stigma,expands the operation link of the recognition mechanism,and puts forward the recognition analysis framework of "qualification-criterion-classification" in three stages.At the qualification level,we should strengthen the active identification to ensure the realization of the national qualification;at the criterion level,we should strengthen the existing identification mechanism,emphasize the spirit of contract to guide the concept of rule of law throughout the identification process;at the classification level,we should give full play to the advantages of network technology to carry out accurate identification.Based on the idea of path optimization and from the perspective of fundraising participants,specific countermeasures and suggestions are given respectively: the regulator needs to provide a good regulatory environment,the platform side should actively bear the direct identification responsibility,the initiator should cultivate the awareness of performing obligations,and the donor should actively exercise the supervision rights.
