The Study On The Circulation Of Collective Construction Land

At present,with the rapid development of China's economic construction and urbanization,the demand and problems of the circulation of collective construction land use right are increasing day by day.The research on the relevant fields of the circulation of collective construction land has become the focus of scholars in various disciplines and relevant government departments and fields.Under the promotion of the central policy,the pilot work of the transfer of rural collective commercial construction land has also been carried out.In August 2019,the new land management law was promulgated.One of the key points of its revision is to relax the restrictions on the circulation of rural collective commercial construction land into the primary market.However,at present,the supporting system of the circulation of rural collective commercial construction land is still not perfect,and there are problems to be solved in the practice of land circulation.Therefore,this paper will take the circulation of rural collective construction land as the research object,hoping to get Suggestions to improve the circulation of collective construction land.The structure of the article is mainly divided into the introduction and three chapters,which are as follows:The introduction mainly includes the background and significance of the research on the circulation of collective construction land,literature review and research methods,innovations and shortcomings.The first chapter is an overview of collective construction land circulation,mainly divided into two parts.The first part starts from the relevant concepts of collective construction land use right circulation,obtains the concept of collective construction land use right through the analysis of "land management law",and on this basis obtains the concept of collective construction land circulation through the analysis of the characteristics of collective construction land circulation.In the second part,through the analysis of the legal provisions of collective construction land in China,the author concludes the achievements and shortcomings in the legislative process of collective construction land in China,which lays a theoretical foundation for the following chapters.The second chapter is the status of collective construction land circulation,divided into three parts.The first part introduces the pilot model of collective land transfer in Wuhu district,Anhui province,and summarizes its experience and problems.The second part introduces the ownership of collective land and analyzes the causes and harms of the disputes.The third part analyzes the income distribution of collective land circulation.In the process of the circulation of the right to the use of collective construction land,the distribution of land value-added income is the key issue of the circulation of the right to the use of collective construction land.By comparing the situation of land revenue collection in Haicheng of Liaoning province and Nanhai of Guangdong province,this paper summarizes the problems and experience in the reform of collective land tax and fee.The third chapter is the improvement of collective construction land circulation,which is divided into four parts.The first part is to improve and develop the collective construction land property rights system.The development of the property right system cannot be separated from the improvement of the collective construction land registration system.As for the problems in collective land,such as the market mechanism effect is not in place,the third part puts forward the Suggestions of constructing a scientific and reasonable price mechanism of collective construction land transfer,including the construction of location rating mechanism and the price mechanism of land resource protection.The fourth part is the improvement of the income distribution system of the circulation of the right to use rural collective construction land,and the protection of the interests of the collective and farmers through the reform of tax collection.The last part of the article is the conclusion and prospect.In addition to the summary of the problems and Suggestions of the collective construction land studied in this paper,the author also makes the prospect of the further development of the circulation of the right to use the collective commercial construction land in rural areas.
