The Third and Fourth Plenary Sessions of the Eighteenth Central Committee of the Party opened a new chapter in comprehensively deepening reforms and governing the country according to law.General Secretary Xi Jinping pointed out: “Sports is one of the important indicators for measuring the progress of society and mankind,and an important lever that reflects the country's comprehensive strength and social civilization.” Therefore,this indicates that the development of the sports industry has a new direction and will inevitably promote sports.Further increase in consumption,especially consumption of sports events.Since the 18 th National Congress of the Communist Party of China,the "Opinions on Promoting Sports Consumption" issued by the State Council [ "Several Opinions of the State Council on Accelerating the Development of the Sports Industry and Promoting Sports Consumption".] And other documents as an opportunity to put forward new requirements for the reform of my country's competitive sports,and also promote a better development direction and new trends in competitive sports.However,there is no relevant system for the protection of the legitimate rights and interests of spectating consumers in sports events.In addition,many systems at this stage are no longer suitable for the development of the sports industry,and some currently effective legal provisions cannot be regarded as sports events at this stage.The legal basis for the protection of the rights of medium-watch consumers.Therefore,this aspect needs to be carefully examined.People's quality of life and consumption concepts change with the development of society and economy.Sports event viewing consumption is the product of this period,and it is a rising consumption method that is favored in people's daily life.However,from the perspective of the nature of sports events,it is a performance service.Watching consumers often fail to recognize their own rights when receiving services.It is inevitable that there will be conflicts between sports event operators and sports event consumers.Although the law clearly stipulates the principle of equal transactions,there is inherent asymmetry between the two in terms of information.Therefore,consumers of sports events are naturally at a disadvantage in protecting their rights.The "Sports Law",as the "basic law" in the field of sports in my country,is the institutional basis for the development of my country's sports industry and the construction of sports law.However,in the relevant provisions of the Competitive Sports Section of my country's "Sports Law",the appeals of many subjects in the field of sports are not comprehensive,especially the lack of attention to the protection of the legitimate rights and interests of spectating consumers in sports events.It is said that the current "Sports Law" of our country has been unable to better meet the needs of the development of competitive sports in the new era.In addition,there is no other legal basis for protecting the legitimate rights and interests of viewing consumers in sports events.With such a background and lack of systems,protecting the legitimate rights and interests of viewing consumers in sports events is worthy of deep consideration and discussion.Competitive sports is an important part of my country's sports industry.Consumers' love and satisfaction with the products and services they provide will directly affect the development of the sports industry.Therefore,taking the infringement of the rights and interests of spectating consumers in current sports events in my country as an index,combined with the "Consumer Rights Protection Law","Sports Law" and other laws and regulations,seek ways to protect the legitimate rights and interests of spectating consumers in sports events in my country,such as The "Consumer Rights Protection Law" and the "Sports Law" should be how to rationally connect,explore the viewing consumer groups in sports events,and based on the theoretical basis of the rights protection of the "Consumer Rights Protection Law".After the rights and interests of such consumers are infringed,how to protect their rights in accordance with the Consumer Rights Protection Law.In addition,in the "Sports Law",should the viewing consumers in sports events and their scope be clearly defined,and how to remedy the damages to their rights? What are the remedies,so as to promote the improvement of the relevant legal system and make up for the legislation in this respect? blank.This article mainly starts from the analysis of the related concepts of spectator consumers in sports events,and clarifies how to define spectator consumers in sports events.Analyze the basic rights of consumers in the "Consumer Rights Protection Law",and consider whether viewing consumers in sports events are fully applicable to the consumer rights stipulated in the "Consumer Rights Protection Law" ? If it does not apply,what rights should it enjoy and what particularities should it have,as well as the way to protect the rights of viewing consumers in sports events in my country.In addition,through elaboration and analysis of the basic rights enjoyed by spectator consumers in sports events in China,the status quo of infringements on their rights during sports events,and the ways of remedy,the current situation of spectator consumers in sports events in my country is reviewed and analyzed.What kind of basic rights are enjoyed.It is hoped that in the development of my country's sports event industry,it can effectively protect the rights and interests of sports event viewers,promote the healthy and sustainable development of the sports event market,and provide a theoretical basis for the establishment of a protection mechanism for the rights and interests of viewers in sports events.
