Research On The Protection System Of Foreign-related Consumers' Rights And Interests

In the era of commodity economy in 21~stt Century,consuming abroad has become a common consumption pattern.Due to the differences in politics,economic base,tradition,culture and geographical environment,the legal protection of overseas consumers in different countries is various,and new legals and regulations are constantly emerging.Because of the conflicts of laws in the process of being used by people,it will cause a lot of issues in private law internationally.With the rapid development of science and technology,the position of overseas consumers is becoming more and more vulnerable in the process of consumption and they are being infringed by illegal merchants increasingly serious.It is of great significance and theoretical value to study the law on the protection of the rights of overseas consumers and its legislative system,which will protect the legitimate interests of overseas consumers,promote the development of foreign trade and strengthen international civil and commercial activities.This paper makes a comprehensive and in-depth study by using comparative methods and empirical analysis methods.This article is divided into four parts.The first part,in the form of cases,discusses the way of overseas consumers'rights protection as well as legislative gap that is contrary to legal fairness and reasonableness.Consumers should be given priority protection because they are weak parties compared with operators,legal persons and other organizations.The second part focuses on the concept and characteristics of the protection of overseas consumers'rights and interests,including the target group and protected methods.When consumers come across some troubles in overseas countries,law conflicts may occur,so does the protection of consumers'rights and interests.The third part focuses on the reality of overseas consumer protection.First of all,we will start from the application of general legal principles,which includes three principles,the closest relationship,the protection of weak parties on rights and interests,and the autonomy of will.By drawing on law of overseas consumer protection from other countries,we will further study the application of law on overseas consumers'rights protection.This paper makes a deeper study on the application of overseas consumer rights and interests protection law.The fourth part are the suggestions for improving the protection of consumers,Through the study of China's law on the application of overseas consumer protection and its shortcomings,this paper explores the better ways to protect the rights and interests of Chinese consumers from the perspective of improving domestic laws.
