| The technological development of the Internet era has caused qualitative changes in the creation,dissemination and use of musical works,completely overturning the original copyright management and protection methods.The old management model of the collective management organization for copyright has not been able to meet the current era of diversified works,and the legislation of the collective management system for copyrights in various countries is also constantly transforming to adapt to technological innovation and the new situation of the industry.Due to the differences in the evolution of copyright legislation in different countries,a clear path has been formed in the collective management system of copyrights,such as the competitive management organizations in the United States and Japan,the statutory monopoly management organizations in Germany,and the extended collective copyright management systems in Nordic countries.These system designs have their own characteristics in dealing with the new situation of copyright management in the network environment.China’s collective management of musical works copyright is still in the initial stage of development.From the detailed design of the system to the micro-operation of the management organization,there is still much room for improvement.The relevant legislation and management models of the above countries can provide great inspiration and reference for copyright management in China.This article cuts through the characteristics of the collective management system of copyright and the characteristics of musical works,and refers to the practices of some countries with better copyright protection legislation.It analyzes the current status and problems of China’s collective management system of copyright in the current network environment,and gives some feasible suggestions,such as establishing a management model for limited competition,establishing a dispute resolution mechanism,and improving the supervision mechanism.It gives solutions to the chaos in the music industry,such as "Exclusive Copyright Licenses",and finally puts forward some institutional imaginations on the copyright protection of the onlineenvironment of music works. |
