In recent years,the development of the Internet has become popular all over the world,and the way people get music has changed a lot.people are increasingly keen to spread and download musical works through the Internet.The development of network and digital communication technology has made great changes in the way people use musical works,it has become more convenient.At the same time,however,it cannot be overlooked that the development of network technology has caused an infrequent system of musical copyright protection.With a certain degree of impact,the licensing system for musical copyrights in the traditional sense,such as collective management licenses,statutory licenses for sound recordings,and direct licenses,in the network environment seems a bit powerless.This article is mainly divided into four parts:The first part mainly discusses music copyright licensing issues in the Network.It discusses the problems and status faced by the music copyright system after encountering the Internet.It also introduces the content of China's existing musical copyright licensing system from the theoretical level,mainly includes licensing,statutory licenses and centralized licenses.The second part mainly discusses the problems in the legislation and practice of the collective management licenses,phonographic licenses and direct licenses under the network environment in China,and analyzes the reasons for the failure of the music copyright system under the network environment.To sort out some of the problems existing in the above realities can provide a basis for us to solve new problems.The third part is the analysis and comparison of copyright licenses for musical worksunder the Internet environment in the United States and Japan.In foreign countries,especially developed countries with mature music industry,the development of the copyright system is relatively complete.The statutory licensing system and centralized management licensing system for sound recordings,combined with the analysis of the licensing system in the United States and Japan,will absorb advanced experience and improve the music copyright licensing system.The last part is the improvement of the copyright licensing system for musical works under the network environment in China.In conjunction with the changes to the “Copyright Law” draft revised in 2012,and in conjunction with the comparative study of the US and Japan related systems,the paper proposes corresponding solutions to the problems in the licensing of musical works under the network environment in China.This will create a more prosperous and stable music market.
