Research On The Insufficience And Improvement Of The Relief System In China's Government Procurement

The "Government Procurement Law" of our country has been in effect since2003,and it has played an irreplaceable role in maintaining the order of the government procurement market,the safety of the use of financial funds,and the legitimate rights and interests of the parties.However,the theoretical logic and practical aspects of the government procurement supplier relief system are still insufficient.Therefore,it is necessary to explore the theoretical basis for establishing the system based on the theoretical and practical aspects,and analyze the problems existing in practice in depth,and put forward suggestions for improving the government procurement supplier relief system.This article first demonstrates that there are two stages of government procurement at the theoretical and logical level.The first stage can be legally formulated as an administrative act.Therefore,in the setting of relief procedures,a procedure similar to the review of administrative acts should be adopted,and then proposed the burden of proof in the handling of government procurement disputes should be borne by the purchaser,and at the same time,the use of reasonable doubts as the proof standard for the trial of the case.At the level of business practice,from the perspective of protecting the legitimate rights and interests of the procurement parties,improving the efficiency and efficiency of the use of financial funds,and the impartiality of the complaint handling organization,it raises questions in parallel with administrative relief,expands the scope of the subject of doubt,establishes an independent administrative relief subject Suggestions for clear investigation of the situation.
