In June 2014,the CPC Central Committee proposed to actively explore and improve the classified management of China's current judicial personnel,establish a post system for judges and prosecutors.Among them,the reform of the staff quota system is the first to bear the brunt.At present,with the continuous deepening of the judicial system reform,the national courts have basically completed the number of judges,but the post system is not limited to the number of judges,post judge withdrawal mechanism as an important part of the post system,also plays an indispensable role.The withdrawal of post judges is a necessary link to promote the reform of the judicial system,which can provide a smooth channel for the professional flow and transformation of post judges,and reverse incentive judges to improve the quality and efficiency of trials.At present,the establishment of supporting systems such as the quota,selection of judges has been gradually improved,but the construction of exit mechanism for judges is still in its infancy.Therefore,the author takes the exit of post judges in a city as the breakthrough point,and puts forward some thoughts and discussions on improving the withdrawal of post judges.This paper studies the withdrawal of post judges from the perspective of management,in order to provide some reference for the management of post judges.Through visiting the intermediate and basic people's courts of a city,the author conducts a full investigation on the income and refund of the basic level local courts by issuing questionnaires and conducting interviews,and finds out the problems in practice.In this paper,through sorting out the current situation of the post judges in the court system of a city,this paper analyzes the causes of the serious brain drain of young and middle-aged judges,the imperfect exit procedure,the imperfect assessment mechanism,and the lack of supporting systems,and puts forward targeted countermeasures and suggestions under the existing system framework by using the relevant management theory,so as to provide the current round of judicial system reform Provide theoretical basis.
