The essence of equal pay is anti-employment discrimination.It is also accompanied by the gradual development of the process of anti-employment discrimination movement.Many countries and international organizations have made more perfect provisions on equal pay.However,the current law of China has only made some principles,relief mechanism and safeguard measures for equal pay.It's almost blank.Through case analysis,this paper finds out the dilemma in the judicial relief of equal pay,the standard of equal pay is not unified,the burden of proof for the workers is heavier,and the employment autonomy of the employer is emphasized in practice.To solve the predicament faced by equal pay,we must go back to the context of anti-employment discrimination.At the same time,we should clarify the connotations of "the same work" and "equal pay",improve the corresponding standard of proof and burden of proof,and innovate the relief procedure of equal pay.
