Labor dispatch can develop rapidly,the main reason lies in the background of The Times,economic take-off,especially in the past thirty years.Whether it is labor dispatch agencies,labor dispatch employees,or the number of labor dispatch workers have shown a trend of explosive growth.One reason lies in the reasonable arrangement of staff posts,improving work efficiency and controlling labor costs.Second,labor dispatch is very flexible,especially conducive to labor units to control their labor costs.Therefore,it has received the favor of various organs,public and private enterprises.At the same time,the nature of profit-seeking enterprises is gradually highlighted,and the problem of different pay for the same work is gradually exposed.For this reason,the state has continuously revised the Labor Contract Law of the People’s Republic of China.In order to regulate and adjust the labor dispatch market,it has issued relevant interim regulations and administrative licensing system.However,there are still a large number of workers do not receive equal pay for equal work.The dilemma of unequal pay for equal work has not yet been completely solved.This article embarks on this realistic dilemma.From the legal system,employing units,employing units,dispatched workers and other angles to consider the causes of this dilemma.In order to explore a path out of the current predicament,to solve the problem of dispatched workers with different pay,and help the healthy development of enterprises and the harmonious development of society.In order to have more practical significance and realistic value,the author also analyzes and studies different types of countries outside the region.For example,Germany,the United States,the United Kingdom to the dispatched workers of equal pay protection norms.Finally,the paper puts forward some suggestions,such as refining the definition standard of equal pay for equal work,adjusting the burden of proof of the parties,determining the legal principle status of equal pay for equal work,promoting equal pay for equal work and the direction of the interests of employers,establishing reasonable labor dispatch industry standard,and constructing a complete supervision system.Thus build a comprehensive labor dispatch security system.
