The Research On Overseas Labor Rights Protection Law System In China

International economic exchanges give a push to the prosperity and stability of global capital,cooperation among countries bring steady development to the whole society,and cultural exchanges promote international understanding and communication,which lay firm foundations for the community of shared future for mankind.As one of the expressions of economic globalization,labor service cooperation has been developing continuously and deeply.Consequently,the amount of labor cooperation disputes increases along with the development of overseas workers.There are two matters on the protection work on oversea workers' rights and interests: One is the problem on international laws,mainly including the lack of diplomatic and consular protection and the deficiency of protection treaty.The other is the situation of domestic law,mainly including the insufficiency on legislation concerning foreign affairs,protection agency and internal coordination,etc.Based on the above problems,there are two methods for improvement.On the international law and rules,we should strengthen the system of diplomatic protection,improve the system of consular protection,and take part in the international labor treaty actively.On the domestic law and rules,we should establish the system of relevant legislation concerning the protection of oversea workers,improve the system of oversea investment insurance,establish the protection institutions for oversea workers' rights and interests,and combine the transformation of government functions and the lower market access.
