With the rapid development of Internet technology,China has entered a new economic era.The sharing economy has brought a lot of convenience to people's life,making people's life more diversified and intelligent.In this economic form,the employment forms are becoming more diversified and flexible,and the form of "platform+individual" has become common.Labor relation is one of the most basic social relations,under the new form of employment,the relationship between employers and employees(i.e.,the relationship between the laborer and platform)has also changed,frequent between employers and individual labor disputes,how to determine labor relations between the two,how to safeguard the lawful rights better and interests of workers under the new situation have become a urgent subject for study.The paper is divided into five parts.The first part is the introduction,which explains that in today's rapid development of sharing economy,the society pays more attention to the relationship between consumers and platforms,and how to better protect the rights and interests of consumers.However,the emergence of new forms of employment brings about problems in the identification of labor relations.Therefore,it is essential to explore the identification of labor relations under the sharing economy.In the process of sorting out domestic and foreign researches,it can be found that there are few scholars and literatures in this field at present.This paper studies this issue,hoping that this paper can provide relevant references in theory and play a positive role in the practice of dealing with labor disputes between platforms and individuals.The second part mainly expounds the origin of the sharing economy.The employment form under the sharing economy is characterized by "platform+individual".In this form,the elements of labor relations begin to change gradually,and the traditional standards of"personal subordination" and "economic subordination" have been seriously challenged to judge the labor relations.Workers can be according to their own time to work;Decentralized workplaces for workers;Labor remuneration also tends to be cooperative,etc.,because the identification of labor relations has become difficult,the protection of workers' rights and interests has become difficult.In the third part,the author considers how to deal with similar disputes faced by China in the sharing economy by referring to the labor disputes about the identification of labor relations between Uber in the UK and the us.Although in the new economic situation,various elements of labor relations have changed,but the result of handling,is to identify the existence of labor relations between the two,to protect the rights and interests of workers.In China,ride-hailing is also one of the most common forms of employment.However,in similar cases,the results are not the same,because China relies on different bases in the process of labor relations identification,and the system is not standardized or perfect.The fourth part is to encourage economic innovation and protect the legitimate rights and interests of workers in the exploration of relevant systems.Since the two are contradictory,the formulation of the system is also ambiguous.In foreign countries,there is an intermediary worker on this issue,which can be used to alleviate such a contradiction.Therefore,our country can also refer to foreign experience to set up the subject of economy-dependent labor provider and take corresponding measures to protect it.The fifth part is the conclusion.In this paper,through the British and American treatment of labor disputes under the new type of employment and the results of similar disputes in our country,as well as the exploration in the system,finally put forward to increase the economic dependence of labor provider subject,and improve measures to protect this subject,to adapt to the development of society.
