In recent years,the "Modern Sharing Economy" represented by the Internet about renting a car has risen rapidly.The modern sharing economy has become a global consensus and the hottest issue of the times by effectively utilizing social idle resources to effectively link supply and demand,enhance the competitiveness of enterprises,solve excess capacity,and promote new industrial models of industrial future and national competitiveness..At the same time,many economic,social and legal issues arising from the modern sharing economy have also triggered tremendous social repercussions.The modern sharing economy has changed the employment model of enterprises and the full-time employment model of labor,which has spawned a new model of "platform + individual".This new mode of employment is fundamentally different from the traditional employment relationship under industrial civilization.Platform enterprises and service providers are neither traditional labor relations nor labor relations,and are vague.The current legal relationship is still difficult to characterize.As a result,legal issues such as the employment relationship between platform companies and service providers have emerged.For example,Uber,Lyft,Handy,Task-rabbit,Didi Travel,and other sharing economic platforms have successively encountered labor litigation,which has affected the overall harmony of labor relations.It poses major challenges for laws and regulations,industry order and corporate management.The relationship between Didi Travel Platform and "Drip Driver" is a typical representative of "platform + personal" fuzzy labor relations.According to the data collection and processing procedures of grounded theory,this study collects rich original data,and through the process of in-depth analysis,conceptualization and categorization,constructs the theoretical model of the influencing factors of fuzzy labor relations under the modern sharing economy.According to the incentive/contribution model,21 influencing factors are summarized into external environment,platform enterprise management,platform employee protection,laborer economic acquisition,laborer self-development,laborer individual coordination and consumer attitude.Finally,based on the exploration of the factors affecting the fuzzy labor relationship in the modern sharing economy,this study proposes governance proposals from several related subjects.The government should balance the flexibility and security of the labor market,improve the regulation of the labor market by the law,explore the establishment of a three-level governance system of macro,meso and micro "three views" and optimize the social security system,while improving the labor market.education and training system.Platform enterprises should strengthen democratic participation in collective bargaining through management innovation,proceed from the needs of service providers,enhance the organizational commitment of service providers,and take the initiative to undertake corporate social responsibility.Service providers should start from their own,improve their labor ability and quality,let them master more discourse power,and improve their awareness of labor rights protection.As a consumer,when evaluating the service quality of a service provider,don't be "wrapped" by irrelevant emotions,and should not abuse the "bad evaluation",and give an objective and true evaluation;at the same time,consumers must be on the Internet.The rapid growth of the economy grows and interacts positively with the consumer process,so that platform service providers and platform companies can continue to make progress.
