Study On The System Construction Of Social Worker Agent In The Trial Of Juvenile Family Affairs

Since entering the 20 th century,the welfare state has sprung up in various parts of the world,and the conservative thought of "not entering the house" has been constantly broken down by the continuous efforts of the modern legislature,and the judicial administrative organs all over the world begin to intervene the family autonomy by the state authorization,meanwhile,Family courts for family cases have sprung up all over the world.China in this trend,but also actively in various courts to promote family trial reform,and launched a number of courts throughout the country to carry out the pilot.In the process of family cases involving underage interests,there is still a lack of a role in protecting the interests of minors as acting guardians.The author tries to explore the rationality of social worker as the supervisor of procedure by analyzing the system of the program supervisor in Germany and Taiwan,and puts forward the feasibility of constructing the guardian mechanism of social workers in mainland China,and puts forward some suggestions on how to improve the participation of the society workers in the family trial.The first part of this paper mainly introduces the concept,main function and function of the program Supervisor System,analyzes its historical evolution,legal basis and applicable scope.The second part of this article from Germany and China's Taiwan and other areas of the program Supervisor system as an example,it is clear that the role and responsibility of the Program Supervisor System are analyzed and the differences between them and the different program subjects are introduced,and the selection and selection of the qualifications are presented,which pave the ways for the construction of similar program supervisor mechanism in family trial.The third part mainly narrates the necessity of constructing the similar procedure supervisor mechanism in the family trial in our country,starts from the realistic question in our country family trial to introduce why our country urgently needs to construct the similar procedure supervising person mechanism,From the analysis of the practical difficulties,why not copy the program Supervisor system and the feasibility of constructing agent guardian mechanism with social workers as the role.The last part of the paper puts forward some suggestions on how to construct the Guardian mechanism of social workers,mainly from the legislative level,the specific design of the mechanism and the talent development strategy,in order to realize the mutual cooperation and mutual benefit of the social work and family trial.
